Travinora — Terms of Use

Preamble

These Terms of Use ("Terms") constitute a legally binding agreement between you ("you," "User," or "Traveler") and CalmGetaways Travel and Tourism L.L.C-FZ, trading as Travinora ("Travinora," "we," "us," or "our"), governing your access to and use of the Travinora website, currently hosted at https://travinora.com/ and its successor official domain(s) (collectively, the "Platform" or "Service").

By creating an account, accessing, or using the Platform in any way, you acknowledge that you have read, understood, and agree to be bound by these Terms, together with our Privacy Policy and any supplemental policies referenced herein (collectively, the "Agreement"). If you do not agree, you must not access or use the Platform.

1. Acceptance of Terms & Eligibility

1.1 Acceptance

Your access to or use of any part of the Platform constitutes your unconditional acceptance of this Agreement. If you are using the Platform on behalf of an organization, you represent that you have authority to bind that organization, and "you" refers to both you individually and that organization.

1.2 Eligibility

To use the Platform, you must:

  • Be at least 18 years of age, or the age of legal majority in your jurisdiction of residence, whichever is greater;
  • Have the legal capacity to enter into a binding contract;
  • Not be barred from receiving services under the laws of the United Arab Emirates or any other applicable jurisdiction, including export control and sanctions laws; and
  • Provide accurate, current, and complete registration information.

Travinora does not knowingly permit use of the Platform by individuals under 18. If we become aware that a user under 18 has created an account, we reserve the right to suspend or terminate that account immediately without notice.

1.3 Changes to Eligibility Requirements

We may modify eligibility requirements at our discretion, effective upon posting of updated Terms, subject to Section 10 (Modifications to Service & Terms).

2. Description of Services & Rebranding Notice

2.1 What Travinora Does

Travinora is a unit of CalmGetaways Travel and Tourism L.L.C-FZ, a company duly licensed under Meydan Free Zone, Government of Dubai (License No. 2203591.01) as an Inbound and Outbound Tour Operator, engaged in arranging and assembling tours — which may include transportation, accommodation, food, and visits to museums, historical or cultural sites, and theatrical, musical, or sporting events — sold directly to travelers or through travel agencies and affiliated operators.

Travinora is the digital platform through which CalmGetaways Travel and Tourism L.L.C-FZ carries out this licensed activity, providing:

  • An interactive, visual trip-planning engine and itinerary builder;
  • Conflict-prevention scheduling tools that flag overlapping or unrealistic itinerary items;
  • Travel-time and transit estimation tools;
  • Destination guides, imagery, and curated content; and
  • Arrangement of, and links to, bookable tours, activities, and experiences offered by affiliated tour operators and travel agencies.

Where a tour, activity, or experience displayed on the Platform is ultimately performed and contracted by an affiliated third-party operator rather than directly by CalmGetaways Travel and Tourism L.L.C-FZ, Travinora acts as an arranger/intermediary for that booking and is not the performing operator or merchant of record for it, as further described in Section 6.

2.2 Rebranding & Domain Transition Notice

The Platform was previously developed and made available under the working domain https://wayfare-nu.vercel.app/, and is now available at Travinora's official branded domain, https://travinora.com/. You acknowledge and agree that:

  • References to "Wayfare," the `wayfare-nu.vercel.app` domain, or associated branding refer to the same Service now operated as "Travinora";
  • Your account, saved itineraries, preferences, and User Content will carry over across this domain transition where technically feasible;
  • URLs, email senders, and visual branding may change without this constituting a material adverse change to your rights under this Agreement; and
  • We will make commercially reasonable efforts to redirect or notify users of domain changes, but we do not guarantee uninterrupted access during transition periods.

2.3 Beta / Evolving Features

Certain features may be labeled "beta," "early access," or similar. Such features are provided experimentally, may be modified or withdrawn at any time, and are provided on an "as-is" basis without the availability or performance guarantees applicable to core features.

3. User Accounts, Authentication & Security

3.1 Account Creation

To access certain features (saving, editing, exporting, or sharing itineraries), you must create an account. Account registration and authentication may be processed through a third-party authentication service provider and/or other authentication methods we may adopt (e.g., social sign-on, email/password, magic links).

3.2 Your Responsibilities

You agree to:

  • Provide accurate and complete registration information and keep it up to date;
  • Maintain the confidentiality of your login credentials and authentication tokens;
  • Immediately notify us at the contact address in Section 13 of any unauthorized access to, or use of, your account; and
  • Accept sole responsibility for all activity occurring under your account, except to the extent caused by our gross negligence or willful misconduct.

3.3 Third-Party Authentication Services

By registering, you also agree to the applicable end-user terms and privacy practices of any third-party service provider we engage to process your authentication data on our behalf. Travinora is not responsible for outages, security incidents, or data handling failures originating solely within that provider's infrastructure, but will take commercially reasonable steps to notify affected users and cooperate with remediation where such incidents affect the Platform.

3.4 Account Security Measures

We implement reasonable technical and organizational safeguards (e.g., encrypted credential storage, secure session handling) to protect your account. However, no system is completely secure, and you acknowledge that you use the Platform at your own risk with respect to security incidents beyond our reasonable control.

3.5 One Account per User

Accounts are personal to you and may not be shared, sold, or transferred without our prior written consent, except through the itinerary-sharing features described in Section 5.

4. Intellectual Property & Platform Ownership

4.1 Ownership of the Platform

The Platform, including its software, source code, algorithms (including conflict-detection and scheduling logic), user interface, visual design, "Travinora" name, logos, trademarks, trade dress, and all underlying technology (collectively, "Travinora IP"), is owned by or licensed to CalmGetaways Travel and Tourism L.L.C-FZ and is protected by intellectual property laws of the United Arab Emirates and applicable international treaties.

4.2 Limited License to You

Subject to your compliance with this Agreement, we grant you a limited, non-exclusive, non-transferable, revocable license to access and use the Platform for your personal, non-commercial trip-planning purposes. No other rights are granted, whether by implication, estoppel, or otherwise.

4.3 Restrictions

You must not, directly or through any third party:

  • Copy, modify, reverse-engineer, decompile, or create derivative works of the Platform or its underlying algorithms;
  • Scrape, crawl, or use automated means to extract data (including destination content, pricing, or availability data) from the Platform, except through APIs we officially publish;
  • Use Travinora's name, logo, or trademarks without prior written permission;
  • Remove, obscure, or alter any proprietary notices; or
  • Use the Platform to build a competing product or service.

4.4 Feedback

If you submit suggestions, feature requests, or feedback regarding the Platform, you grant us a perpetual, irrevocable, royalty-free, worldwide license to use, incorporate, and commercialize such feedback without obligation or compensation to you.

5. User-Generated Content & Shared Itineraries

5.1 Your Content

"User Content" means itineraries, notes, custom trip names, preferences, uploaded images, comments, and other materials you create, upload, or generate using the Platform.

5.2 Ownership

As between you and Travinora, you retain all ownership rights in your User Content. We do not claim ownership of your itineraries or the creative choices reflected in them.

5.3 License Granted to Travinora

By creating, saving, exporting, or sharing User Content on the Platform, you grant Travinora a non-exclusive, worldwide, royalty-free, sublicensable, and transferable license to host, store, reproduce, display, adapt (e.g., for responsive formatting or export file generation), and distribute your User Content solely for the purposes of:

  • Operating, maintaining, and improving the Platform;
  • Enabling features you activate, such as itinerary sharing via link, PDF/export generation, or collaborative trip planning; and
  • Displaying your shared itineraries to recipients you designate or, if you elect a public-sharing feature, to the public.

This license terminates for content you delete from the Platform, except to the extent (a) it has been shared with and saved by other users prior to deletion, (b) retention is required for backups or legal compliance, or (c) it remains embedded in a shared link already distributed.

5.4 Shared & Collaborative Itineraries

If you use sharing or collaboration features, you acknowledge that:

  • Content shared via public or semi-public links may be viewed by anyone with the link, or, for public listings, by the general public;
  • Collaborators you invite may view, and, if permissioned, edit shared itineraries; and
  • You are solely responsible for the appropriateness of content you choose to share, including personal information you voluntarily include (e.g., names, contact details).

5.5 Content Standards

You represent and warrant that your User Content does not infringe any third party's intellectual property, privacy, or other rights, and does not contain unlawful, defamatory, obscene, or harassing material. We reserve the right, but have no obligation, to review, moderate, or remove User Content that violates this Agreement.

5.6 Third-Party Content in Itineraries

Destination images, descriptions, and activity data pulled into your itinerary from our third-party content, mapping, and booking partners remain the property of their respective providers and are subject to the license terms of those providers, as referenced in Section 6.

6. Third-Party Services & Affiliated Booking Partners

The Platform integrates with, and relies upon, a range of third-party service providers to deliver mapping, imagery, authentication, and booking-related functionality. We do not publicly disclose the specific identity of individual technology or booking partners we work with, as this information is treated as confidential and proprietary to our business. Your use of any integrated third-party functionality is also governed by that provider's own terms and privacy policy, which are generally made available to you at the point where you interact with that functionality (for example, at checkout on a partner's booking page).

6.1 Mapping, Routing & Location Services

Travel-time estimates, routing, mapping, and geolocation features displayed on the Platform are powered by third-party mapping and location-data service providers. Distance, duration, and route data are estimates only, may not reflect real-time traffic, closures, or local conditions, and must be independently verified before travel decisions are made based on them.

6.2 Affiliated Tour & Activity Booking Partners

Consistent with CalmGetaways Travel and Tourism L.L.C-FZ's licensed activity of arranging and assembling tours, the Platform displays and arranges bookings for a wide range of tours, activities, and travel experiences, sourced through affiliated tour operators, travel agencies, and booking partners. When you proceed to book an activity:

  • Depending on the specific tour or activity, the booking may be completed directly through Travinora acting as arranger for CalmGetaways Travel and Tourism L.L.C-FZ, or you may be directed to an affiliated third-party operator's own platform to complete the transaction;
  • Where an affiliated third-party operator is the performing supplier, Travinora is not the seller, merchant of record, or contracting party for that booking, and the contract for the tour, activity, or experience is formed directly between you and that operator, subject to their own terms, cancellation policies, and pricing;
  • Travinora may receive a commission or referral fee from affiliated partners when you complete a booking originating from the Platform — this does not increase the price you pay and is disclosed here for transparency; and
  • We do not process, store, or have access to your full payment card details submitted directly to an affiliated third-party operator's own payment system.

6.3 Destination & Activity Imagery

Destination and activity imagery displayed on the Platform may be sourced from third-party image content providers under license. Images remain the property of their respective providers and are used for illustrative purposes; they may not always depict the exact venue, season, or current condition of a destination.

6.4 Authentication Services

As described in Section 3.3, account creation and login may be facilitated by a third-party authentication service provider, subject to that provider's own terms and privacy policy.

6.5 General Third-Party Disclaimer

We do not control, endorse, or assume responsibility for any third-party service, website, or content accessible through or integrated with the Platform. Availability, accuracy, and pricing of third-party data may change without notice and are outside our control. Your dealings with any third party (including bookings, payments, disputes, refunds, or cancellations) are solely between you and that third party, and you release Travinora from any claims arising from such dealings to the fullest extent permitted by law.

6.6 Affiliate & Commission Disclosure

In accordance with applicable consumer protection and advertising standards, you acknowledge that Travinora participates in affiliate and commission-based arrangements with certain tour operators and booking partners, and may earn commissions or referral fees on qualifying bookings made through the Platform.

7. Disclaimers of Warranties & No Guarantee of Travel Accuracy

7.1 "As-Is" Basis

THE PLATFORM AND ALL CONTENT, TOOLS, AND FEATURES ARE PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING WITHOUT LIMITATION WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, ACCURACY, OR UNINTERRUPTED/ERROR-FREE OPERATION, TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW.

7.2 No Guarantee of Travel Accuracy

You specifically acknowledge that:

  • Travel times, transit durations, and routing data are algorithmic estimates derived from third-party mapping and location-data services and may not reflect real-time traffic, weather, road closures, strikes, or other disruptions;
  • Conflict-detection and scheduling tools are planning aids based on estimated durations and user-entered data; they do not guarantee that an itinerary is physically feasible, and unforeseen delays may render a planned schedule impossible to complete;
  • Experience availability, pricing, and schedules displayed on the Platform are supplied in whole or in part by affiliated tour operators and booking partners, are subject to change without notice, and may not be accurate at the time of your visit to the Platform or at the time of booking; and
  • Destination guide content and imagery are provided for general informational and illustrative purposes and may not reflect current conditions, opening hours, entry requirements, health/safety advisories, or visa/travel document requirements.

You are solely responsible for independently verifying all travel-critical information — including transit times, operating hours, visa and entry requirements, health and safety conditions, and booking terms — directly with the relevant transport provider, venue, embassy/consulate, or tour operator before relying on it for actual travel.

7.3 No Professional Advice

Nothing on the Platform constitutes travel agency advice, legal advice, immigration advice, medical advice, or a guarantee of any kind regarding your trip.

7.4 Jurisdictional Limits

Some jurisdictions do not allow the exclusion of certain warranties, so some of the above exclusions may not apply to you in full; in such cases, our warranties are limited to the minimum scope permitted by applicable law.

8. Limitation of Liability & Indemnification

8.1 Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL TRAVINORA, ITS PARENT ENTITY CALMGETAWAYS TRAVEL AND TOURISM L.L.C-FZ, OR THEIR RESPECTIVE OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, OR LICENSORS BE LIABLE FOR:

  • Any indirect, incidental, special, consequential, exemplary, or punitive damages, including loss of profits, data, goodwill, or travel opportunities;
  • Any damages, losses, delays, injuries, illness, death, or expenses arising from or related to third-party tours, activities, transportation, accommodation, or other travel services booked through an affiliated third-party operator or booking partner, including cancellations, no-shows, operator insolvency, negligence, or non-performance by that third party;
  • Missed transport connections, missed reservations, or itinerary disruptions resulting from inaccurate travel-time estimates, mapping data, or conflict-detection outputs;
  • Any harm resulting from your reliance on destination guide content, imagery, or third-party data without independent verification; or
  • Any unauthorized access to, alteration of, or loss of your account or User Content, except where directly caused by our gross negligence or willful misconduct.

Where liability cannot be fully excluded under mandatory law, Travinora's aggregate liability arising out of or relating to this Agreement or the Platform shall not exceed the greater of (a) the total fees, if any, paid by you to Travinora directly (excluding amounts paid to third-party operators) in the twelve (12) months preceding the claim, or (b) AED 500.

8.2 Indemnification

You agree to indemnify, defend, and hold harmless Travinora, CalmGetaways Travel and Tourism L.L.C-FZ, and their respective officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising out of or related to:

  • Your violation of this Agreement;
  • Your User Content, including any infringement or violation of a third party's rights;
  • Your use or misuse of third-party services (including affiliated tour and activity bookings) accessed through the Platform; or
  • Your violation of any applicable law or the rights of any third party.

9. Prohibited Conduct & Fair Usage

You agree not to, and not to permit any third party to:

  1. Use the Platform for any unlawful purpose or in violation of any applicable local, national, or international law or regulation, including sanctions and export control laws;
  2. Impersonate any person or entity, or misrepresent your affiliation with any person or entity;
  3. Upload or transmit viruses, malware, or any code designed to disrupt, damage, or limit the functioning of the Platform or any connected system;
  4. Attempt to gain unauthorized access to the Platform, other users' accounts, or our servers/networks;
  5. Use bots, scrapers, or other automated means to access the Platform beyond normal, individual human usage, or to extract data at a scale inconsistent with personal trip planning;
  6. Circumvent, disable, or interfere with security-related features, rate limits, or usage restrictions of the Platform or the third-party services it integrates with, including any fair-use limits imposed on us by our third-party service providers;
  7. Reproduce, resell, or commercially exploit the Platform, its data, or its content without our prior written authorization;
  8. Post or share User Content that is unlawful, defamatory, obscene, hateful, or that infringes third-party rights;
  9. Use the Platform to harass, stalk, or harm another person, including through the itinerary-sharing or collaboration features; or
  10. Interfere with or disrupt the integrity or performance of the Platform, including through excessive automated requests that degrade Service performance for other users.

We reserve the right to investigate and take appropriate action, including suspension or termination of your account and, where warranted, referral to law enforcement, for violations of this Section.

10. Modifications to Service & Terms

10.1 Changes to the Service

We may modify, suspend, or discontinue any part of the Platform (including specific features, integrations, or third-party data sources) at any time, with or without notice. We are not liable to you for any modification, suspension, or discontinuation of the Service.

10.2 Changes to These Terms

We may revise this Agreement from time to time to reflect changes in our Service, legal requirements, or business practices. When we make material changes, we will:

  • Update the "Last Updated" date at the top of this document; and
  • Provide notice via the Platform, email, or a similar reasonable method for material changes, where practicable.

Your continued use of the Platform after the effective date of revised Terms constitutes your acceptance of the revised Terms. If you do not agree to the revised Terms, you must stop using the Platform and may close your account.

11. Termination of Accounts

11.1 Termination by You

You may stop using the Platform and delete your account at any time via account settings or by contacting us at the email in Section 13.

11.2 Termination or Suspension by Us

We may suspend or terminate your account or access to the Platform, in whole or in part, at our discretion and without prior notice, including where:

  • You breach this Agreement or any incorporated policy;
  • We are required to do so by law or by direction of a competent authority;
  • Your account is inactive for an extended period; or
  • We reasonably believe your conduct poses a risk to the Platform, other users, or third parties.

11.3 Effect of Termination

Upon termination:

  • Your license to access and use the Platform immediately ceases;
  • We may delete your account data and User Content, subject to any retention obligations under applicable law or Section 5.3; and
  • Sections of this Agreement that by their nature should survive termination (including Sections 4, 5.3 (as applicable), 7, 8, 12, and 13) will survive.

12. Governing Law & Dispute Resolution

12.1 Governing Law

This Agreement and any dispute or claim arising out of or in connection with it (including non-contractual disputes or claims) shall be governed by and construed in accordance with the laws of the United Arab Emirates, as applied in the Emirate of Dubai, without regard to conflict-of-law principles.

12.2 Jurisdiction

You irrevocably agree that the courts of Dubai, United Arab Emirates shall have exclusive jurisdiction to settle any dispute or claim arising out of or in connection with this Agreement or its subject matter, and you submit to the jurisdiction of such courts.

12.3 Informal Resolution First

Before initiating formal proceedings, you agree to first contact us at the email address in Section 13 to attempt to resolve the dispute informally. We will attempt to resolve the dispute informally within thirty (30) days of receiving notice.

12.4 No Class Actions

To the extent permitted by applicable law, any dispute resolution proceedings will be conducted only on an individual basis and not in a class, consolidated, or representative action.

14. Miscellaneous

14.1 Entire Agreement

This Agreement, together with our Privacy Policy and any other policies referenced herein, constitutes the entire agreement between you and Travinora regarding the Platform and supersedes all prior agreements and understandings.

14.2 Severability

If any provision of this Agreement is held invalid or unenforceable, that provision will be limited or eliminated to the minimum extent necessary, and the remaining provisions will remain in full force and effect.

14.3 No Waiver

Our failure to enforce any right or provision of this Agreement will not be deemed a waiver of such right or provision.

14.4 Assignment

You may not assign or transfer this Agreement without our prior written consent. We may assign this Agreement, including in connection with a merger, acquisition, corporate reorganization, or sale of assets, without restriction.

14.5 Force Majeure

We are not liable for any failure or delay in performance resulting from causes beyond our reasonable control, including natural disasters, acts of government, labor disputes, internet/telecommunications failures, or outages of the third-party service providers we rely upon.

14.6 Language

This Agreement is drafted in English. Any translation provided is for convenience only, and the English version shall prevail in case of conflict.

By using the Travinora Platform, you acknowledge that you have read, understood, and agree to be bound by these Terms of Use.
